Terms of Service
These Terms govern your use of the Presence beta service operated by Arron Hartt. By creating an account or using Presence, you agree to these Terms. If you use Presence for an organization, you confirm that you have authority to do so.
Beta service
Presence is an evolving beta product. Features may change, experience interruptions, or be discontinued. Presence is not an emergency, safety, employee-attendance, timekeeping, or legally required availability system. Always use an appropriate direct method for urgent communication.
Your account and connected services
You are responsible for activity under your account and for every calendar, organization, device, phone system, feed, and shared link you connect or create. You must have permission to connect each account, calendar, or phone system and must follow the connected provider's terms. Keep private status, display, organization, Shortcut, and webhook links secure and replace them if they may have been exposed.
Organizations, Groups, and Reception Views
Organization owners may invite members, organize them into overlapping Groups, label Group Leads, and share Reception View or Group View links only with authorized people. A Group Lead label is organizational and does not grant access to private calendar, meeting, location, or activity information. Members control whether they appear and which broad workplace label they share. Owners may permanently delete a team, which disables its shared views and removes its memberships without deleting members' personal accounts.
Presence is an availability and interruption-reduction tool, not an employee-monitoring system. Organization features must not be used for covert monitoring, productivity scoring, performance evaluation, attendance enforcement, timekeeping, discrimination, emergencies, or surveillance. Organization owners are responsible for lawful workplace notices, policies, permissions, retention requirements, and access to shared-view links. They must not make employment or disciplinary decisions based solely on a Presence status, which may be delayed, incomplete, or incorrect. Members must be allowed to understand what information is shown about them and to use available visibility controls.
Acceptable use
You may not access another person's data without permission, misrepresent your identity or availability for unlawful purposes, stalk or monitor people, distribute malware, probe or disrupt the service, evade limits, abuse integrations, reverse engineer non-public systems where prohibited by law, or use Presence in violation of law or another service's terms.
Privacy and calendar information
Presence processes account, calendar, status, device, and chosen-place information as described in the Privacy Policy. Read-only calendar access does not allow Presence to edit calendar events. Simplified statuses can still reveal something about a person's availability, so share links only with intended recipients.
Weekly recaps
Optional weekly recaps are private estimates based on simplified signals Presence observed. They are provided for personal reflection and interruption reduction, not timekeeping, attendance, payroll, productivity measurement, performance evaluation, or proof of work. A recap may be incomplete when a device or connection is offline. Users can turn the feature off from the dashboard.
Your content and suggestions
You retain ownership of information and suggestions you submit, including custom status wording. You grant Presence the limited permission needed to host, process, transmit, and display your information through the account and shared views you enable. You are responsible for custom wording you create and must not use it to violate law, another person’s rights, workplace policy, or these Terms. Do not place confidential or sensitive information in a custom status intended for shared views. You also permit Presence to use and adapt non-confidential suggestions without restriction or compensation. Do not submit confidential information through suggestion forms.
Presence ownership
Presence and its original software, design, content, and branding are owned by Arron Hartt and protected by applicable laws. These Terms grant you a limited, revocable, non-transferable right to use the hosted service. They do not grant permission to copy, sell, sublicense, or redistribute its non-public code or assets.
Subscriptions
Paid plans are not currently active. Before billing begins, Presence will display the applicable price, billing interval, renewal and cancellation terms, taxes, and nonprofit eligibility. Beta pricing and features may change before paid service launches.
Third-party services and trademarks
Presence relies on third parties including Render, Amazon and AWS for the optional Alexa beta, Google, Microsoft, Zoom, Webex, Todoist, calendar providers, Resend, GitHub, Google Analytics, TRMNL, and any future payment processor. Their terms and availability apply to the services they provide. Presence is not responsible for third-party outages, account restrictions, routine behavior, connected-device actions, or policy changes.
Presence is an independent service. It is not affiliated with, endorsed by, sponsored by, or an official product of Amazon, Alexa, Apple, Google, Microsoft, Zoom, Webex, Cisco, Todoist, TRMNL, Twilio, or other third-party providers unless Presence expressly states otherwise. Their names, logos, products, and trademarks belong to their respective owners and are used only to identify compatibility or integration.
Account deletion and termination
You may delete your account from the dashboard. Deletion removes the account and associated stored Presence data as described in the Privacy Policy and revokes connected Google access when possible. After deletion, review the connected-app or authorized-app settings in Google, Microsoft, Zoom, and Webex and remove Presence if it remains listed. An organization administrator may need to complete that step for a managed account. Some limited security, legal, backup, or anonymized records may remain for the periods described there. Presence may suspend access when reasonably necessary to address misuse, security risk, legal obligations, or service integrity.
Disclaimers
To the maximum extent allowed by law, the beta service is provided “as is” and “as available,” without warranties of uninterrupted operation, accuracy, fitness for a particular purpose, merchantability, or non-infringement. Presence statuses may be delayed, incomplete, or wrong. Some jurisdictions do not allow certain disclaimers, so they apply only to the extent permitted.
Limitation of liability
To the maximum extent allowed by law, Presence and its operator will not be liable for indirect, incidental, special, consequential, exemplary, or lost-profit damages arising from the service. Nothing in these Terms excludes liability that cannot legally be excluded.
Changes
Material updates will be posted here with a revised date. Continued use after an update takes effect means you accept the revised Terms. If you do not agree, stop using Presence and delete your account.
